Foster care of unaccompanied minors in the Czech Republic

1 ABSTRACT The aim of the bachelor thesis is to find the principle of host care of unaccompanied foreigner minors in the Czech Republic and describe its main benefits and drawbacks. The theoretical part summarizes the main characteristics of host care and describes the main benefit according to the authors of field literature. The empirical part of the work presents the results of a research survey, which took place in the form of semi-structured interviews with hosts whose families provide care to unaccompanied minors, as well as with a refugee aid organization which seeks to create a system of accompaniment, counselling and other elements that provide the necessary support and enable the treatment of potential risks. The analysis of the interviews shows that this system is currently planned in detail within the project of the mentioned non-profit organization and the individual parts of the project are gradually being implemented. From the comparison of the analysis of interviews with the literature, it is clear that the hosts need quality preparation and subsequent support, given that this form of care involves certain risks, both for minors and for the hosts themselves. Exil on the brink of maturity

The intended work examines how the relationship between the unaccompanied migrants and the hosts is formed within foster care. Foster care could be defined as "long-term and repetitive contacts," where specific forms of relationship are negotiated between individual actors. I ask what activities and practices the actors make significant concerning the arrival, what ideas and imaginations on the part of the actors enter into the relationship, and how emotional rules are negotiated in a relationship. Last but not least, the work examines how the individual actors relate to the category of unaccompanied minors, that is, how this category, which has its legal definition, is negotiated. The United Nation Convention on the Rights of the Child in the case of refugee children

This Bachelor thesis addresses the issue of the basic human rights of Refugee Children guaranteed to every child by UN Convention on the Rights of the Child adopted in 1989. The thesis describes the processes and situations in which a Refugee Child who is accompanied by family members or who is an Unaccompanied Minor goes through during the proceeding of International Protection in the European countries. The thesis focuses only on the articles of Convention that are applicable to crucial problems in the current situation of Refugee Children.
Comparison of social and legal situation of unaccompanied minors in the Czech Republic and Austria

The theme of the work is to compare social and legal situation of unaccompanied minors (UAMs) from third countries, who find themselves in the territory of the Czech Republic and Austria, and these countries have subsequently provided them care and protection. Work aims to describe the history of the system of care, possible types of residence of these children, conditions of their security and identifying of their age in the two above-mentioned countries. Emphasis is also on the system of care, involving social and legal protection, housing, custody area, education, health care, as well as the search for durable solutions in the area of residence, the family reunification and reintegration. Then, I will try by using analysis to compare what these various aspects of their social and legal situation differ in, what they are identical in or which country better respects the so-called "appropriate procedures of Separated Children in Europe Programme ". I would also like to point out some deficiencies in the system or vice versa examples of good practice in both countries.
Administrative Detention of Foreigners

of the thesis This thesis deals with the institute of administrative detention according to the Czech legal system. The term administrative detention is used to designate deprivations of liberty under administrative law for the reasons that are directly linked to the immigration policies of the state. In the context of migration law the detention may be basically used for two purposes. First purpose is to ensure the realization of administrative deportation of the foreigner. Second purpose is to prevent the foreigner from an unauthorized entry into the country. Both irregular migrants and asylum seekers fall under the scope of this work. Although different norms are applicable to each of these categories, both of them are subject to detention on the same ground - the lack of state authorization for their presence on national territory. The purpose of this paper is to detail the legal framework with which deprivation of liberty of migrants must comply in particular for what concerns the fundamental principle of international law that no one should be subjected to arbitrary detention. International human rights norms, principles and standards define the content of that principle. Ethics as a normative standard in European Asylum Policy: case study of unaccompanied minors

This bachelor thesis focuses on European asylum policy with the attention to unaccompanied minors. The aim is to find out on which principales the Common europen asylum system is based, how and whereas the specific situation of the unaccompanied minors is taken into consideration and where are the weaknesses while implementing the system into reality. The first theoretical chapter summarizes theoretical basis of ethics and regarding the relation ethics and migration. The second chapter is devoted to prncipales of asylum policy and its implemention into European common asylum system. The third chapter analyzes the realization of policiy through cases studies, especially in Hungary and Sweden.
